General Terms and Conditions of Großer Kern GmbH for Participation in the Hörnchen Club

1. Scope

The General Terms and Conditions for participation in the Hörnchen Club (Club GTC) apply to the use of the Hörnchen Club in the online shop of Großer Kern GmbH (hereinafter “knuspr.de”) at www.knuspr.de.

2. What is the Hörnchen Club?

The Hörnchen Club is a loyalty program for customers already registered at knuspr.de (i.e., customers who already have a customer account at knuspr.de), aimed at expectant parents as well as parents of children between 0–12 years of age (“customers”).

4. Conclusion of Contract

When you register for the Hörnchen Club, a contractual relationship between you and knuspr.de is established. Registration in the Hörnchen Club is a prerequisite for participation in the Hörnchen Club. Registration and participation are free of charge and voluntary.

The General Terms and Conditions of knuspr.de (“GTC”), available at https://www.knuspr.de/seite/agb, apply to the Hörnchen Club and are supplemented by these General Terms and Conditions of the Hörnchen Club (“Club GTC”). In the event of contradictions, the GTC of knuspr.de take precedence.

5. Registration in the Hörnchen Club and Data Processing

You can become a member of the Hörnchen Club if you are a customer at knuspr.de. We reserve the right to refuse participation for certain individuals or to exclude members. There is no legal entitlement to membership in the Hörnchen Club.

When registering for the Hörnchen Club, you must provide your child’s first name, gender, and date of birth. Expectant parents need only provide the expected due date and – if known – the gender of the child. After confirmation of membership by knuspr.de (only then does membership exist), you will be notified by knuspr.de by e-mail and your customer account will be expanded to include the membership area.

By entering the child’s data, you confirm that you are authorized to share this data.

Communications of the Hörnchen Club will be sent to the e-mail address stored in the customer account. The member consents to being contacted by knuspr.de by e-mail regarding member promotions and discounts or offers, including third-party content related to the Hörnchen Club. Please notify us electronically (by e-mail) or update your customer account if your data changes.

6. Hörnchen Club Benefits

Free Shipping

Free shipping applies Monday through Friday for deliveries between 10:00 and 16:00 (excluding express deliveries or deliveries within 15-minute time slots).

Order Bonuses:

• Access to member-exclusive products

If you spend €120 or more:
14-day upgrade: 10% off private labels, 10% off organic products, exclusive access, and 15-minute delivery slots.

Hörnchen Club benefits are available to members only. Discounts cannot be transferred to other members.

7. Termination of Membership

You may terminate your membership at any time without giving reasons and without notice via the link https://www.knuspr.de/hoernchen-club. All acquired discounts and other club benefits expire irrevocably upon termination of the account and cannot be reinstated or transferred.

We may terminate by e-mail with six weeks’ notice. After four weeks from expiry, all discounts and other club benefits irrevocably expire and cannot be reinstated or transferred.

Knuspr.de reserves the right to discontinue the Hörnchen Club at any time without giving reasons or to replace it with another club. In the event of dissolution of the Hörnchen Club, all acquired discounts and other club benefits irrevocably expire.

8. Data Protection

The privacy policy of knuspr.de, available at https://www.knuspr.de/seite/datenschutzerklaerung, forms an integral part of these GTC. There you will find detailed information on the processing of personal data and data subject rights. 9. Liability

We are liable to you in all cases of contractual and non-contractual liability in cases of intent and gross negligence in accordance with the statutory provisions for damages or reimbursement of futile expenses.

In other cases – unless otherwise regulated – we are only liable in the event of a breach of an essential contractual obligation, the fulfillment of which is essential for the proper execution of the contract and on whose compliance you regularly rely, and then limited to the compensation of foreseeable and typical damage. In all other cases, our liability is excluded, subject to the following provision.

Our liability for damages resulting from injury to life, body, or health and under the Product Liability Act remains unaffected by the above limitations and exclusions of liability.

knuspr.de does not guarantee permanent availability of the technical systems associated with the Hörnchen Club. If the technical system of the Hörnchen Club for recording discounts and credits is (even temporarily) unavailable, no claims against knuspr.de arise.

10. Applicable Law, Place of Performance

For contracts with businesses, the court with jurisdiction for the registered office of knuspr.de is exclusively agreed as the place of jurisdiction. If you are a consumer, you may choose between your local court of residence and the court at the registered office of the company. The contracting parties agree – unless mandatory statutory provisions provide otherwise – on the application of German law. The UN Convention on Contracts for the International Sale of Goods as well as all provisions relating to the UN Sales Convention are expressly excluded. Mandatory consumer protection provisions under the law of the state in which the consumer has their habitual residence remain unaffected.
